Please read these Terms of Use carefully before using PitchEdge. By accessing or using our service, you agree to be bound by these terms. If you do not agree, do not use the service.

1. About PitchEdge

PitchEdge is an AI-powered sales training platform that provides voice-based objection handling practice and performance scoring for sales teams. The service is operated in the United Kingdom.

2. Eligibility

By using PitchEdge, you confirm that:

  • You are at least 18 years of age
  • You are accessing the service on behalf of a legitimate business
  • You have the authority to bind your organisation to these terms where applicable
  • You are not located in a jurisdiction where use of such services is prohibited

3. The service

PitchEdge provides:

  • AI-powered voice training calls simulating real client objections
  • Automated performance scoring and feedback following each call
  • A management dashboard for tracking team performance over time
  • Custom objection libraries tailored to your industry and product

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

4. Account responsibilities

Where an account is created for your team:

  • You are responsible for maintaining the security and confidentiality of your account credentials
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorised access or security breach at info@getpitchedge.co.uk
  • You must not share login credentials with individuals outside your organisation
  • You must ensure all team members using the platform are made aware of these terms

5. Acceptable use

You agree to use PitchEdge only for its intended purpose as a sales training tool. You must not:

  • Use the service for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to reverse engineer, decompile, or extract the underlying AI models or software
  • Use the platform to train AI systems outside of the PitchEdge service
  • Attempt to circumvent any security or access controls
  • Upload or transmit any malicious code, viruses, or harmful content
  • Use the service to harass, abuse, or harm others
  • Resell or sublicense access to the platform without our written consent
  • Use automated systems or bots to access the service in an unauthorised manner
  • Record calls beyond what is permitted under applicable law in your jurisdiction

6. Call recording and consent

All training calls made through PitchEdge are recorded for the purpose of generating performance scores and feedback. By making or permitting calls through the platform, you confirm that:

  • You have informed all team members that their training calls will be recorded and processed
  • All relevant team members have consented to being recorded for training purposes
  • You have obtained any necessary consents required under applicable law in your jurisdiction

You accept responsibility for ensuring appropriate consent has been obtained from all users within your organisation prior to their use of the platform.

7. Intellectual property

All intellectual property rights in the PitchEdge platform, including its software, AI models, design, branding, and content, are owned by or licensed to PitchEdge. Nothing in these terms grants you any rights to our intellectual property.

You retain ownership of any content you provide to us, including custom objection scripts. By providing this content, you grant PitchEdge a non-exclusive, royalty-free licence to use it solely for the purpose of operating and improving the service for your account.

Performance data, scores, and analytics generated by the platform remain the property of PitchEdge, though you have a right to access and export data relating to your account during your subscription.

8. Confidentiality

Each party agrees to keep confidential any information received from the other party that is marked as confidential or that would reasonably be understood to be confidential. This obligation does not apply to information that is publicly available, already known to the receiving party, or required to be disclosed by law.

9. Payment and billing

Where a paid plan is agreed:

  • Fees are as agreed in your service agreement with PitchEdge
  • Invoices are due within 30 days of issue unless otherwise agreed in writing
  • All fees are exclusive of VAT, which will be charged at the applicable rate
  • We reserve the right to suspend access to the service for overdue accounts
  • Refunds are not provided for partial months or unused call credits unless otherwise agreed

10. Trial period

Where a free trial is offered, it is available once per organisation. We reserve the right to withdraw trial access at any time. Upon expiry of the trial, continued use of the service will require a paid subscription.

11. Limitation of liability

To the fullest extent permitted by applicable law:

  • PitchEdge is provided on an "as is" and "as available" basis without warranties of any kind
  • We do not warrant that the service will be uninterrupted, error-free, or meet your specific requirements
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • We are not liable for any loss of profits, revenue, data, business, or goodwill
  • Our total aggregate liability to you for any claim arising out of or relating to these terms or the service shall not exceed the total fees paid by you to us in the three months preceding the claim

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

12. Indemnity

You agree to indemnify and hold harmless PitchEdge and its officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of the service, your breach of these terms, or your violation of any applicable law or regulation.

13. Third-party services

PitchEdge integrates with third-party services including Twilio, ElevenLabs, and OpenAI. We are not responsible for the availability, performance, or content of these third-party services. Your use of these services through PitchEdge is subject to their respective terms and policies.

14. Termination

Either party may terminate access to the service by providing written notice in accordance with the terms of your service agreement. We reserve the right to terminate or suspend access immediately if you breach these terms, engage in fraudulent activity, or if required to do so by law.

Upon termination, your right to access the service ceases. We will retain your data for 12 months following termination, after which it will be permanently deleted, unless you request earlier deletion in writing.

15. Changes to these terms

We may update these Terms of Use from time to time. Where changes are material, we will notify you at least 30 days in advance by email. Your continued use of the service after the effective date of any changes constitutes acceptance of the updated terms.

16. Governing law and disputes

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before initiating formal legal proceedings, we encourage you to contact us at info@getpitchedge.co.uk to attempt to resolve any dispute informally.

17. Entire agreement

These Terms of Use, together with our Privacy Policy, Cookie Policy, and any separate service agreement, constitute the entire agreement between you and PitchEdge in relation to your use of the service and supersede all prior agreements and understandings.
